My neighbour smokes in her back door/garden & its coming right into my kitchen,is it classed as a public area?

our gardens are attatched by a fence, shes blows her smoke right into all my windows and doors and lets her dog bark and wake up my baby early in morning and late at night!! were in england and its illegal to smoke in public places, just wondered if this would be classed as public area? x

i have polish people who smoke in my close and the people in the street seems to find it’s way into my house when the windows open. What can you do? If anything you could speak to the local authorities housing officer since they immediate theses problems.

At a push you could sue for causing you health problems.
